Enforcement and compliance

Workplace Standards uses promotion, education and advice to encourage compliance with the provisions of the legislation we administer.

Where needed, compliance can also be secured through the use of formal notices and directions, and other enforcement methods provided for under the legislation.

Infringement notices and on-the-spot fines

Prosecution is normally a last resort. However, in some circumstances, it is the only appropriate response and the only means of deterring other prospective offenders from contravening the legislation.

Workplace inspections

An inspector may visit a workplace either by appointment or unannounced.

While some visits are arranged in advance with the employer, there are many circumstances when prior warning is not given.

This may include blitz audits or inspections, and investigations of complaints involving an alleged occupational health and safety breach, dangerous circumstance, incidence or accident.
