Inspectors have a number of powers under the Workplace Health and Safety Act 1995.
They include:
Inspectors must carry and produce their identification on request.
Inspectors can issue Notices requiring that hazards be remedied or that specified work be suspended until a hazard is remedied.
The Dangerous Goods Act 1998 contains similar powers for Authorised officers. In addition, the Authorised officers may 'inspect any dangerous goods upon their importation or introduction into this State, and at such times thereafter, as the Inspector deems necessary'.
Similarly, the Industrial Relations Act 1984 gives the Inspector right of entry; the power to require the employer to produce any record required to be kept under this Act; and the power to question any person in connection with matters covered by this Act.
Under the Workers Rehabilitation and Compensation Act 1988 the Authorised Officer may require the employer to produce any policies of insurance; any record kept by the employer under this Act; and any record relating to the employment of workers.
