Nominating Authorities (NAs) are central to the administration of adjudication services under the Act.
They are authorised to undertake the following functions
They may charge fees for the services they provide.
Before authorising a NA, Workplace Standards Tasmania must have regard to guidelines issued by the Minister.
NAs are required, as a condition of authorisation, to ensure that the adjudicators they nominate meet minimum core competencies and comply with professional standards of conduct.
A list of Nominating Authorities can be located on the page linked below.
Guidelines and conditions of authorisation can be located on the Resources page linked below.
For payment disputes regarding contracts entered on or after 17 December 2009, adjudicators are appointed by a NA after an adjudication application is lodged with them. The nominated adjudicator notifies the parties to the payment dispute that he or she has accepted the adjudication application.
It is important to note that adjudicators are not appointed by Workplace Standards Tasmania. They are private individuals engaged by Nominating Authorities on the basis of their knowledge and skills relating to adjudication of building and construction industry payment disputes.
Guidance notes about payment disputes and adjudication can be located on the Resources page linked below.
