Pro-rata long service leave

For an employee, whose contract of employment is covered by the Long Service Leave Act 1976, to be entitled to a pro-rata long service leave payment, they would need to have either:

  • 15 years continuous service (10 years for mining employees) or more with their employer,
  • or 7 years service (5 for mining employees) but less than 15 years (10 for mining employees) and be leaving due to an illness, incapacity, domestic or other pressing necessity of such nature as to justify termination, or attained the age for retirement, or an employee whose employment is terminated by his employer for any reason other than the serious and wilful misconduct of the employee.

Disputes regarding claims under this Act are heard and determined by the Tasmanian Industrial Commission and are predominately pro-rata disputes.
